THE LEGAL APPRAISAL OF BABY FACTORIES IN NIGERIA

Abstract

The study’s central focus is on the legal Appraisal of Baby factories in Nigeria.
The research subject is quite a novel and one that tends to arouse interest of
scholars and readers. The general challenges of infertility which is the major
cause of delay or bane in reproduction and its effects was highlighted. Baby
factories in Nigeria and its practices was x-rayed of course the first baby
factory discovered in Nigeria was made public in 2008. In the same vein,
factors promoting baby factories was evaluated. The study also considered the
sales and trafficking of children and children as victims of baby factories
respectively. Legal frameworks regulating the activities of the baby factories
both nationally and international were appraised, to wit; the constitution of
the Federal Republic of Nigeria 1999(as amended), the Criminal Code, Penal
Code and the Child’s Right Act 2003. Others are; the United Convention of
Rights of a Child 1989, The Hague Convention 1993, The United Nation
Organization for Education, Science, and Culture( UNESCO) 2006 and The
United Nation convention on Rights of a Child 2003. The Federal Ministry of
Health, the Judiciary, National Agency for Prohibition of Trafficking in
Persons 2003 and Non-Governmental organization as motivations changed
with the responsibility to regulate and supervise the subject of research were
highlighted. The study concluded with summary of findings and
recommendations.
